UPDATE: Elections supervisors to quit processing voter purge list

by Dara Kam | June 1st, 2012

Elections supervisors will stop using a flawed list of potential non-citizens to scrub the voter rolls, Martin County Supervisor of Elections Vicki Davis, president of the state’s elections supervisors association, said this morning.

The U.S. Department of Justice yesterday told Secretary of State Ken Detzner that the voter purge process, launched by Detzner in April, appears to violate at least two federal voting laws. DOJ gave Detzner until June 6 to respond.

The Justice Department letter and the problematic list make the scrub undoable, Davis said.

“That’s why we’re just stopping. There are just too many variables with this entire process at this time for supervisors to continue,” Davis, president of the Florida State Association of Supervisors of Elections, said.

Ron Labasky, the association’s general counsel, is sending a memo to the state’s 67 elections supervisors this morning telling them to stop processing the list, Davis said.

“My advice under these circumstances, and based upon the previous issues that have been presented concerning the list, as well as the fact that the Department has indicated its intent to take further actions to review its list to determine its validity, I recommend that Supervisors of Elections cease any further action until the issues were raised by the Department of Justice are resolved between the parties or by a Court,” Labasky wrote to the supervisors today.

Detzner in April sent a list of more than 2,600 flagged voters identified as potential non-citizens by matching the state’s voter registration database with driver’s license records. But the error-riddled list included the names of U.S.-born citizens – like one Brooklyn-born war hero – and others who are naturalized citizens.

At their summer meeting last month, elections supervisors of both parties raised objections to the list to state Division of Elections officials, who then said the Department of Highway Safety and Motor Vehicles would scrub the list more carefully using a Department of Homeland Security database.

But yesterday, Labasky told the supervisors that Detzner’s office said DHSMV could not run the names through the federal database. Detzner, a Republican, also yesterday again asked Homeland Security officials for access to the database.

The non-citizen purge list – the brainchild of Republican Gov. Rick Scott – has created a national firestorm over elections in crucial swing-state Florida and has sparked a partisan battle over what to do next.

Republican Party of Florida Chairman Lenny Curry this morning announced an online campaign to get people to contact the White House and ask for access to the federal Systematic Alien Verification for Entitlements, or SAVE, database.

Democrats say the voter purge process is part of a GOP effort to keep voters away from the polls in November.

A federal judge yesterday blocked portions of a controversial elections law passed last year, saying a 48-hour requirement for third party groups to turn in voter registration forms was “harsh and impractical.”

Now please call the agencies we complained to and THANK THEM for their action in defense of democracy!

Find your county Supervisor of Elections and THANK THEM for stopping the illegal voter purge:

They are trying to STEAL our votes and STEAL the election, so let’s show them we refuse to accept their tactics by taking action to register more voters than EVER BEFORE!

    Instructions to register are here:

  4. Searcher Says:

So, another attempt to manipulate voter rolls by our Republican Governor has been found to be illegal. How much money has Scott WASTED passing such political rules?

  5. Plead the 5th 75 Times Says:

Isn’t it funny how the GOP and Tea Party love to wrap themselves in the Constitution, yet so many of this governor’s actions are regularly shot down as unconstitutional. Hypocrisy is the first thought that come to my mind.

  6. louie Says:

There’s pretty much no reason or benefit to being a citizen anymore.
    Maybe there once was…maybe.
    But now ?
    Non-citizens will be voting ?
I need to show more ID to return something at Home Depot if I lost the receipt.
    That’s not right.

  7. Floirdian Says:

@Plead the 5th. Yes, shot down by Liberal judges that wouldn’t know the Constitution if it bit them in the a**. Purge illegal voters.. what could be more right than that?

  8. legal voter Says:

What’s so wrong with verifying voter information and comparing it with the Federal Database? Don’t we want to ensure that only eligible voters are actually voting? Oh, that right, immigration status is meaningless. Elections have been decided over only a few votes. If those votes were cast by people not eligible then the election was a fraud. Accuracy over political party!

  9. Tea Lady Says:

This really is an issue of States’ Rights!

The Tenth Amendment to The Constitution of These United States:

“The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

    Clearly, this issue is a State matter, not for federal Big Government interference! Let The States handle this! ={

  10. STOP THE PURGE Says:

    “legal voter”,

Do you honestly believe what RICK SCOTT is saying?

Given both his track record and the clear provable fact that he is violating federal law with the voter purge less than 30 days before the primary…

I have to ask… why on Earth would you trust a thing he says?

Why would you pretend that there is a big problem of non-citizens voting when you and everyone else knows that there have been almost ZERO prosecutions for non-citizen voting?

    I’ll answer for you.

    It’s politics.

You care more about the Republican Party — and their anti-Middle Class Wall Street agenda — than you do for what is right and good and just for America.

You STILL support the GOP even if it means looking the other way while your party openly violates federal law.

The Republican Party and people like you have NO MORALS and NO VALUES. Period. When you have such open disregard for the rule of law, your morals and values and patriotism are questionable at best.

  11. wyn Says:

How can you accept proof of someone’s citizenship twenty or so years ago and now say it is invalid. Chances are the records of 20 or so years are probably more accurate than the oenes today. If the GOP and Tea Party folks want to abide by the constitution they love to quote and most times misquote, then learn to abide by it and stop trying to purge real citizens and voting eligible folks from the voter rolls. There is nothing wrong with verifying voter data if it is done correctly. Florida doesn’t have the capability our ethics to do this kind of job.

  12. STOP THE PURGE Says:

    Tea Lady,

We KNOW you hate the UNITED STATES of America.

We know you hate the U.S. Constitution.

But thanks for reminding all of us how the right wing hates the country of their own birth and prefers a totally different form of government to our current system of checks and balances.

  13. wyn Says:

Florida GOPers will do anything to deny legitimate voters their voting rights. Just shows how scared they are of losing Florida to the Democrats.

  14. RobWPB Says:

Anti American Commies!!!!!!!! – 180,000 people on this list. About five have been found to be wrong. Big Deal! You lousy Americans don’t care about right or wrong. You would rather have 179,995 fraudulent voters, voting your way, instead of doing the right thing and getting rid of the names that CANNOT vote and SHOULD NOT vote. You show your true characters as Liberals. You F’n selfishness is going to destroy this country, but what do you care, as long as you get free crap! You will finally get it when they board your waste of oxygen on to a train!

  15. RobWPB Says:

Dara Kam: The SUPERVISORS are going to stop? Really? Who told you that? Because some attorney is sending a letter.. Betcha they don’t stop… and if any do, they should be arrested and tried for treason…. Bottom Line!

  16. Jose Rodrigues Domingo Perez Says:

@STOPTHEPURGE, I took your advice and checked my voter status. Good news, I’m eligible. Doesn’t matter that I’m illegal. Democracy in action!!

  17. STOP THE PURGE Says:

In Hillsborough County alone they found 5 citizens were purged and AT LEAST one more was purged and admitted to accidentally throwing away his letter.

So that makes 6 in that one county alone. 6 out of 73 that were on his purge list.

Do the math. 6 out of 73 is 8%.

Extrapolating an 8% error rate over the entire 2600 person list and you have 208 LEGAL AMERICAN CITIZENS IN THE STATE OF FLORIDA WHO WERE PURGED.

And the Governor’s office has said that this is just the beginning of the purges.

208 citizens denied the right to vote. With many more coming. The difference between President Bush and President Gore was just above 500 votes.

Basically, you are endorsing ELECTION THEFT.

Way to be an upstanding citizen and patriotic American.

  18. STOP THE PURGE Says:

Btw, in case you don’t believe me about Hillsborough County…

In addition to the six voters who were able to prove to the Hillsborough County Supervisor of Elections office that the state’s database was incorrect, Craig Latimer says it’s possible other registered voters received the certified letter and threw it away.

One voter told him he’d done just that. When Latimer called him, the voter said that he was born in Canada and that when he was very young, his parents came to the United States and obtained citizenship. He became a citizen as well. “‘I served 12 years in the U.S. Navy,’ he told Latimer. ‘I threw your letter away.’”

So, again, you are ENDORSING ELECTION THEFT and a violation of federal law and civil rights.

SHAME ON YOU. You are no patriot.

  19. Florda Legislator Says:

    Constitution? What that is?

  20. STOP THE PURGE Says:

    Btw, RobWPB,

I am Jewish and I find this comment that you made to be unspeakably offensive:

“You will finally get it when they board your waste of oxygen on to a train!”

So in a series of posts that you have made, you are calling for election theft, calling for violation of federal law, and implying that you want to do to Democrats what Nazis did to my ancestors.

  21. INELIGIBLE Says:

Every Eligible voter should vote. Every voter should be able to show his eligibility and identity.

The effort of Florida is to get the INELIGIBLE off the list. The dead, the illegal, the felons. Makes good sense.

We stop paying social security to dead people.. we should take them off the rolls.

  22. sam Says:

Voter fraud is a fear based creation of the right to give them ammunition to suppress the vote. There is no voter fraud problem, the system works exactly as it is supposed. Rather, this is a ploy to intimidate and to suppress.

  23. Ralphyboy Says:

I guess RobWPB missed algebra. If 8% were in error, that means 92% should have been removed.

1 vote, in the Senate, decided the “stimulus and Obamacare”. Al Franken won by just over 300 votes. Convicted felons, who did not have their rights restored, voted in Minnesota. 23 have been convicted and their names were public record. 10 were selected, at random and asked for whom they had voted. 9 of the 10 said Franken. See there is no need to worry about voter fraud.

  24. STOP THE PURGE Says:

Where is the list of non-citizens prosecuted for voting in Florida?

And while you’re at it, why don’t you explain why the Florida DOE engaged the voter purge illegally within 90 days of an election.

    Why’d they do that?

    Go for it.

  25. STOP THE PURGE Says:

Here, doing your homework FOR you since you are too dishonest to do it for everyone to see.

In Central Florida, they found 5 non-citizens registered to vote out of 102 who were purged. 6 people were citizens. So they actually purged more citizens than they caught illegal voters. ZERO out of the 5 people who were improperly registered had EVER cast a vote.

And remember, MORE people who were eligible citizens were purged than illegals caught.

The Orlando Sentinel crunches the numbers:

There are more than 1.2 million registered voters in the four Central Florida counties. That means the five confirmed cases account for one in every 240,000 registered voters.

    1 / 240,000 is 0.00042%

0.00042% is the percentage of registered voters who are non-citizens in Central Florida.

And the percentage of those voters who actually commited voter fraud by voting as a non-U.S. citizen is 0%.

    There’s your voter fraud problem.

0% of the 1.2 million voters in Central Florida committed voter fraud by voting as a non-citizen.

And because of this, we have to purge thousands of eligible American citizens from the voter rolls.

Honestly, every single which way you look at this thing, IT STINKS.

    Period, end of story.

  26. Tom Says:

This Fla. governor is a real tool of the right wing.

  27. IGetIt Says:

Agree with Sam and Stop the Purge – there are already checks and balances in place to prevent voter fraud, hence the reason there has been 0 voter fraud prosecutions. And while the list should ensure that those not eligible to vote are not on it – you don’t purge with a list that is clearly flawed and you don’t do it 90 days before an election.

  28. Tim Jerque Says:

Considering the racist and unconstitutional previous actions of the stooge Holder and the dope Obama, it is not surprising that the Marxist left wants to stop any attempt to keep the voting process legit. I love how the leftist posters here act so indignant while the only reason to oppose showing ID to vote is to commit fraud. After he is defeated in November Obama, Holder, Pelosi, Reed and the other traitors should be tried and frogwalked to a labor camp. These leftist moron Judges are true tools of the communist elitist left. They will be dealt with too. Democrats: the new Nazi and KKK party. How’s that pizz-azz economy workin out for all you leftist morons?

  29. STOP THE PURGE Says:

“Democrats: the new Nazi and KKK party”

Honestly? This is all you have? Lies and innuendo?

I am Jewish and I find your disgusting comments to be egregiously offensive.

By endorsing Big Government voter fraud, you are endorsing the kind of fraudulent elections we’ve seen in Russia with Putin.

It is disgusting and un-American that you prefer a rigged fraud of an election to the very founding principles of the American government, namely, open and honest elections and a truly representative democracy.

  30. David Says:

Tim Jerque (Jerk?), what a balanced and nuanced diatribe! In case you missed it, the Nazis were a RIGHT wing party, not a left. If I’m a communist (not) I can’t be a Nazi. Read a history book if you can – this is simply the latest method to attempt to disenfranchise low-income and minorities. It was attempted after the Civil War to eliminate former slaves from the polls, and continued for decades with poll tests, reading tests, etc., all of which were finally recognized for what they were – the ravings of bigots who couldn’t stand the idea of someone who had different color skin or a lower economic status actually voting in a way that they didn’t like. By the way I’m also getting very tired of being called un-American, communist, socialist, KKK, Nazi, etc. for simply having a different opinion. I’m a white, patriotic American who wishes only the best for the people of this country.

  31. Bob Says:

    @Stop the Purge.

“By endorsing Big Government voter fraud, you are endorsing the kind of fraudulent elections we’ve seen in Russia with Putin.”

You seem to be the one endorsing voter fraud. Should they have a correct method of weeding out ineligible voters? Of course. Should they do it irrespective of a 90 day window? Absolutely. There is no place for ineligible voters to be voting on the elections, and it is people like you who support it, because you know that your Messiah is having a hard time in this election, and he needs every single ineligible and dead voter possible to win.
What kind of person really would be against purging ineligible voters? Nobody who matters.
The list needs to be fixed for accuracy and the purge needs to be completed. Needs to happen in every state.

  32. TonyaA6 Says:

What is going to happen to the VALID records that have already been purged?

  33. STOP THE PURGE Says:

“”"Should they have a correct method of weeding out ineligible voters? Of course. Should they do it irrespective of a 90 day window? Absolutely.”"”

That’s ALL I EVER SAID jerk.

“”"it is people like you who support it, because you know that your Messiah blah blah blahhhh”"”

You are just another in a long long long long long list of pathologically dishonest Republicans.

Just ANOTHER right wing nutjob who is more than willing to cast aspersions anonymously on the interwebs about their fellow American without any evidence whatsoever.

You just fire me up even more to make sure that ever eligible voter is REGISTERED, VOTES, and that vote is properly COUNTED.

Go back and look at the stats I posted above.

That number is the percentage of people in 4 central FL counties who were non-citizens who were registered to vote.

    Not 4%. Not 0.4%.

And the number of those non-citizens who actually cast an improper vote?

Meanwhile, more actual eligible voters were purged in those four counties than non-citizen voters who were improperly registered!

How on EARTH can you still defend the indefensible?

There is only one way and I described it above… it is a PATHOLOGICAL DISHONESTY that has pervaded the Republican Party. It is simply undeniable at this point that Republicans in the United States of America in the year 2012 are exhibiting symptoms of mass hysteria, including but not limited to severe, recurrent, pathological dishonesty.

  34. STOP THE PURGE Says:

It depends on the county supervisor of elections.

I live in Broward and so I called them to make sure they have a fail-safe method of preventing improper purges.

It turns out that non-responders to the initial voter purge letter will NOT be removed from the voter rolls. The only way they get removed if there is a non-response to the initial letter is if there is some evidence that they are improperly registered.

So, in Broward at least, it appears as though they have a handle on things and that no people will be improperly taken off the rolls.

But I STRONGLY encourage you to call your county supervisor of elections and ask them your question. I found the Broward county folks to be extremely helpful and professional, and when I’ve called them they were happy to see that people care about having sound, fair elections. So yeah, I encourage you to follow up with your county supervisor of elections.

Here is the website where you can find out how to contact your SOE:

  35. Jim Says:

Once again the Republicans while crying about freedom, liberty and the Constitution are on every front trying to subvert, destroy and deny those very principles.
Their False crisis of voter fraud is designed to weaken the most sacred function of a democratic society, an individuals RIGHT TO VOTE, so that they can secure elected office by fraud and deception. If that is what they are willing to do to gain elected office what can the people expect from their governance? We need only look at the last 30 years of Republican governance to see the American people suffer while greed and self interest thrive.
Gov Scott should be held accountable as should the other 37 states that have bogus Koch Brothers sponsored “voter fraud” legislation. Their actions demonstrate on every issue their contempt for the American people, and that contempt is reflected in their policies. For proof look no further than the Paul Ryan Republican Budget plain and the devastating consequences it will have on millions of American.
We The People must stay vigilant from all threats both foreign and Domestic.
We must work together to insure every American can register and VOTE.
As Thomas Jefferson said “An educated citizenry is a vital requisite for our survival as a free people.”

  36. the truth hurts Says:

It’s very simple for the republicans to show proof of massive voter fraud. Publish the photos of every felon convicted of voter fraud on the front page of every newspaper in the state.

  37. Dee Says:

Who can blame the Rethugs. It worked for them last time.

    OBAMA 2012

  38. RobWPB Says:

Whining Crying Liberals.. nothing new.. they dont care if it takes breaking the law to keep their criminal party in office. See you on the trains boys…

  39. STOP THE PURGE Says:

“”"they dont care if it takes breaking the law”"”

What the hell are you talking about?

YOUR PARTY is the one defying federal law!

My gawd. You must be drunk.
